Is cannabis legal in New York?
Yes. Cannabis is legal in New York for adults aged 21 and older, who may possess up to three ounces of flower or 24 grams of concentrate and buy only from dispensaries licensed by the Office of Cannabis Management. Unlicensed sales, sales to minors, and driving under the influence remain illegal.
Can I drive with cannabis in my car in New York?
Yes, but only sealed. Cannabis may be transported in its original sealed packaging, kept out of reach — ideally in the trunk. Unsealed product in the passenger compartment is illegal under VTL §1227(2) even if unused, and consuming cannabis in a vehicle on a public road is prohibited.
Is cannabis delivery legal in New York?
Yes. Delivery is legal when carried out by a service licensed by the Office of Cannabis Management. Orders go only to the purchaser after ID and age verification, and only to private residences or consenting private businesses in the state.
Can I grow cannabis at home in New York?
Yes. Adults 21 and older may grow up to three mature and three immature plants for personal use, with a household cap of six mature and six immature plants. Home-grown cannabis may not be sold, and grow areas must be secured against access by minors.
Is medical cannabis different from recreational in New York?
Yes. Medical cannabis requires certification by a state-registered health care provider and registration with the state, while recreational cannabis is open to any adult 21 or older. The two differ in eligibility, possession limits, product testing, taxes, and legal protections.
Where can I legally consume cannabis in New York?
In private residences and most places where tobacco smoking is allowed. Adults 21 and older may consume at home, or in another person's home with permission. Use is illegal in a motor vehicle, in a private business that has not permitted it, and anywhere tobacco smoking is banned.
How do I get a cannabis dispensary license in New York?
By applying to the Office of Cannabis Management. The application must include a vendor contract for an electronic inventory tracking system and proof of control over the proposed licensed premises, plus the other OCM licensing forms. Review, site inspection, and issuance follow.
Can I take cannabis from New York to a neighboring state?
No. Crossing state lines with cannabis is illegal under the federal Controlled Substances Act, even between two states that have both legalised it. Driving with cannabis inside New York is permitted under state rules on sealed packaging and secure transport.
Can my employer drug test me for cannabis in New York?
Generally no. Under the MRTA, employers may test for marijuana only in limited cases: testing required by federal or state law, on-site possession, or visible signs of impairment. Lawful off-duty use is protected, but employers may still ban use on the job.
Can I get a DWAI for driving after using cannabis in New York?
Yes. Vehicle and Traffic Law §1192(4) turns on whether your ability to drive was impaired, not on a measured THC level, so a charge is possible with no specific amount in your system. A first offence is generally a misdemeanour.
